SB86: The Bill That Hands the Hemp Market to Big Marijuana

Senate Bill 86 isn’t about safety. It’s not about public health. It’s about control.

This bill would ban nearly every hemp-derived product that’s currently keeping Ohio hemp stores alive. Delta-8. Delta-10. HHC. Anything with more than 0.3% total THC. All of it — gone.

But the bill doesn’t ban THC altogether. It just says you can only get it from one place — state-licensed marijuana dispensaries.

Let’s break that down. Hemp stores would lose their best-selling products. Dispensaries would gain a monopoly. And lawmakers are helping make that happen.

SB86 doesn’t level the playing field. It flips the table.

It tells small business owners who’ve followed the law that they’re now illegal. It tells customers who rely on hemp products that they’ll need a card, a new doctor, or a lot more money to keep using what works for them. It tells corporate cannabis companies they’ve won — without competition.

Dispensaries didn’t build this market. Hemp retailers did. They took risks. They followed unclear rules. They explained new products to skeptical customers. They earned trust in their towns. Now they’re being pushed aside.

And for what? For a bill written so broadly it would shut down half the industry. A bill that doesn’t distinguish between clean, compliant stores and actual bad actors. A bill that serves one kind of business at the expense of everyone else.

This isn’t good policy. This is a handout to big players who don’t want competition.

Ohio’s hemp stores aren’t asking for special treatment. They’re asking for fair rules, clear enforcement, and a chance to grow without fear. SB86 gives them the opposite.

It’s not about safety. It’s about market share. And if we don’t stop it, the only place you’ll be able to buy hemp-derived products in Ohio will be from the people who paid for the privilege.
